The Committee recommends to the State party to ensure that, in cases where the person deprived of liberty does not consent to share information about the deprivation of liberty, the management of the duty of confidentiality and right to privacy respect the conditions set forth in article 20 of the Convention. Furthermore, the Committee urges the State party to guarantee a right to a prompt and effective judicial remedy as a means of obtaining without delay the information referred to in article 18 (1) of the Convention. This right may not be suspended or restricted in any circumstances, as provided for in article 20.
